By accessing or using cutQ ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service. These terms apply to all users, including customers and business owners.
2. Description of Service
cutQ is a queue management and booking platform that connects customers with barbershops, salons, and beauty clinics in Australia. Our Service allows users to join queues remotely, book appointments, and receive real-time updates about wait times.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access
- Accept responsibility for all activities under your account
4. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Harass, abuse, or harm other users or businesses
- Submit false or misleading information
- Interfere with or disrupt the Service
- Attempt to gain unauthorised access to our systems
- Use automated systems to access the Service without permission
5. Bookings and Queue Entries
When you make a booking or join a queue:
- You are entering into an arrangement with the business, not cutQ
- Wait times and availability are estimates and may vary
- Businesses may have their own cancellation policies
- You should arrive at the specified time to maintain your place
- Repeated no-shows may result in account restrictions
6. Business Partners
Businesses using cutQ are independent entities. cutQ does not employ, control, or supervise these businesses. We are not responsible for the quality of services provided by businesses, their compliance with laws, or any disputes between you and a business.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by cutQ and are protected by Australian and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure. To the fullest extent permitted by Australian Consumer Law, we disclaim all warranties, express or implied.
9. Limitation of Liability
To the maximum extent permitted by law, cutQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless cutQ, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, businesses, or cutQ. You may also terminate your account at any time by contacting us.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales.
